論香港勞動行政法制之社會法定位:以行政賞罰為例

On the Social Law Status of Labor Administrative Legal System in Hong Kong: Taking Administrative Reward and Punishment as an Example

摘要


因受英國統治之影響,香港之法律體系多被認定為「海洋法系」,其司法權之行使由判例法體系可知,海洋法系對於行政權限縮之特色,便顯而易見。然而,1997年香港回歸後,其法律文化在原有海洋法系下所建構之「二元體系」,新增了第三元結構。此第三元即為全國人大及其常委會所制定之香港相關法律。而中國大陸所建制以社會主義為基礎之「中華法系」建構,便可能與香港以「海洋法系」作為基礎之法制,產生適用上之衝突。本文以傳統上多強調「行政權」協助甚至主導之「勞動法」領域,由「社會法」層次出發,作為論述香港法體系之基底,以探究香港勞動法於相關已訂明之法規範中,及香港社會所發生之社會案例,是否能充分調和不同法系間之衝突?以供香港勞動社會適用。進而,本文擬以「行政賞罰」之手段為例,延伸探討香港勞動法形成「勞動行政法」之可行性。期能透由本篇論述,為香港勞動行政與法系衝突等議題,提供解方。

Due to the influence of British rule, the legal system of Hong Kong has been identified as "the Department of the Common Law". The exercise of its judicial power can be known from the case law system. The characteristics of the Department of the Common Law are obvious. However, after the return of Hong Kong in 1997, its legal culture was built on the "dual system" under the original system of the sea law, adding a third-dimensional structure. This third element is the relevant Hong Kong law enacted by the National People's Congress and its Standing Committee. The construction of the "Chinese legal system" based on socialism based on the Chinese mainland may be related to Hong Kong's "Common Law System" as the basis of the legal system, resulting in conflicts in application. This article traditionally emphasizes the "administrative power" to help or even dominate the "labor law" field, starting from the "social law" level, as the basis for discussing the Hong Kong legal system, to explore the Hong Kong labor law in the relevant prescribed law, And can the social case of Hong Kong society fully reconcile conflicts between different legal systems? For the Hong Kong labor community to apply. Furthermore, this article intends to take the example of "administrative reward and punishment" as an example to extend the feasibility of forming a "labor administration law" in Hong Kong's labor law. The period can be explained by this article, providing solutions for issues such as labor administration and legal conflicts in Hong Kong.
