台英校園霸凌防制政策之比較分析:教育法之觀點

School Bullying Prevention Policies in England and Taiwan: From the Perspective of Education Law

摘要


校園霸凌已成為先進國家教育政策之重要議題,而英國係少數已針對不同霸凌行為制定法律規範之OECD會員國,其大力推動學校教育改革,強調校園安全與學習品質之重要,並視校園霸凌防制為中小學校園安全政策之優先內涵,相關政策發展經驗值得我國借鏡。因此,本研究採用歷史比較法,透過教育法之觀點,對我國與英國防制校園霸凌政策之內涵進行分析。本研究之分析結果顯示:台、英校園霸凌防制政策均遵守行政法之原則,強調學生人身安全之維護,並重視學校教職員反霸凌專業知能之訓練。而英國防制校園霸凌之法制模式、家長義務規範、替代教育建置及對霸凌行為人之懲戒措施等事項,皆有可供我國政府部門借鏡之處。

School bullying has become a key issue of education policies in advanced countries. The U.K. government, one of the few members of OECD, has passed a special law to regulate different types of bullying. It has prioritized anti-bullying in school safety and has shown positive performance. Therefore, this study examines the measures for the prevention of bullying in schools in U.K. and Taiwan, using historical-comparative research, from the perspective of education law. This study concludes the following: (1) anti-bullying policies for schools in U.K. and Taiwan must conform to the principles of administrative law; (2) these policies highlight the personal safety of students and care about the training for anti-bullying skills of staffs in schools; (3) the Taiwanese government may benefit from emulating U.K. with regard to the legal accountability for parents, legalization model of anti-bullying policies, disciplinary measures for bullies, and the alternative education system.
