清官能斷家務事？－兒少保護社會工作者個案處遇角色作為之省思

摘要

社會工作是一門是幫助個人、團體或社區增強其社會功能和提升社會適應的專業。其中，兒少保護社會工作者在工作任務與角色執行上更顯複雜。這是因為被保護的兒童及少年因其發展階段而有權益保護和決策判斷上的弱勢。也因為現實的情況使得社會工作專業助人工作手法的特性、社會環境、政策與法令、規則與制度，以及案主和其成長的交互影響歷程，平添許多變數。社會工作者藉由法律所賦予的公權力，不僅需要對於必須被協助和保護的兒童與少年提供干預，而且必須對案主進行必要的仲裁、判斷和權控。這意味著社會工作者不只是問題解決的伙伴，還是裁判。社會工作者相對於被保護的兒童和少年案主，以及他們的家屬或照顧者的角色關係，儼然成了「官」與民的角色對應。本文主旨乃在於嘗試從國內現行的實務執行概況，和相關文獻與研究的內容，以華人文化的角度思考社會工作者在兒少保護服務工作上如何為「官」？有無足夠能力或條件為「官」？進而提出社會工作者在兒少保護處遇角色作為中的反省，並討論其中尚待釐清的議題。期望本文的結論與建議能提供社會工作領域的伙伴在未來進行相關領域的工作，以及社會工作專業教育未來的發展規劃上做為參考。

Social work is a profession that assists individuals, groups, and communities to solve problems, empower their social function and strengthen social adjustment. Especially, the child protection social workers in the enforcement of tasks and roles are more complex. Not because children and adolescents in a developmental stage that their rights and abilities of decision making both need to be protected. And the real situation makes many variables in a process which the characteristics of the social work professional practices, social environment, policies and laws, rules and institutions, interact with children's growth.Child protective Social workers who own the public authority by law, must both provide intervention, and carry out arbitration, judgment and domination to children and adolescents who need be assisted and protected. It means that social workers in children protection treatment, are not only partners of solving problems, but also referees. The relationship between social workers and clients who are children and adolescents protected and their families or caregivers, seems to have become the role mapping of ”mandarin and civilian”.From the way of getting an overview of domestic practical implementation, related literatures and researches at present, the purpose of this paper attempts to think and exam how can child protection social workers be a 'mandarin' in the perspective of Chinese culture? And whether child protection social workers have enough competence to be the ”official” or not? Then brings up introspection of the roles about child protective social workers in treatment process, and discusses the issues which needs to be clarified. Finally, result and suggestions of this paper could be a reference to practice agencies and members in child protection field for thinking about intervention, and formulating social work professional education program in the future.
