勞工安全衛生教育訓練現況分析與複訓機制之研究-以某光電廠之承攬商為例

摘要


本研究以某光電廠之承攬商為例,目的在探討1.光電廠之承攬商現行安全衛生教育訓練自辦或委外辦理及訓練途徑。2.承攬商於目前依照現行法規推動之安全衛生教育訓練所面臨之困境與未來所執行方向。3.承攬商之勞工安全衛生人員在辦理安全衛生教育訓練時所應具備之專業知識。4.分析我國實施安全衛生教育訓練之現況及複訓(回流教育)執行成效。5.訂定改善現況之建議方案,供政府及事業單位作為參考。綜合研究結果發現及建議:1.安全衛生教育訓練辦理情形,因零星工程、雇主成本考量、人數限制(委外辦理)及時間上無法配合等,實際辦理教育訓練之承攬商應為少數。且主要方式為現場講授方式占絕大多數,以實際演練或演習採用者最少。2.自行辦理勞工安全衛生訓練最大困難依序為,教材缺乏、授課專業人材不足、業務過於繁忙等,故希望政府能將安全衛生教育訓練納入國民義務教育中,推動安全衛生教育訓練普及化從國民義務教育做起。3.勞工安全衛生人員之專業知識,現階段由於施作零星工程之承攬商佔大部分,故雇主為了節省成本有部分的承攬商之安全衛生人員是由工地主任或是工程師兼任,故對於專業知識僅止於當初專任安全衛生人員交接之需定期更新文書資料及業主所交代之事項。4.複訓之現況,確實有施行教育訓練複訓的為極少數,因人力流失及約聘、人力派遣的勞工不在少數,大多數所以勞工無法於規定的期限內接受複訓。5.對於政府機關所舉辦之安全衛生教育訓練課程,除了海報宣導、媒體廣告外,有賴於事業單位主動告知。6.希望政府依每事業單位類別制定安全衛生教育訓練手冊,除了載明事業單位類別之安全衛生專業知識及技術外,並將各教育訓練舉辦單位、課程內容簡介、上課時數、所要具備之資格、證照之考取、複訓方式及連絡電話等,使勞工能夠積極主參與,提升自身知專業技能。

The study employed an optoelectronic plant's contractor as an example. The purposes of the study are to investigate 1.the optoelectronic plant contractor's current self-organized or outsourced safety and health education and training and training pathways; 2.the dilemmas and future enforcement directions for the contractor's current promotion of safety and health education and training in accordance with the existing laws; 3. the professional knowledge of contractor's labor safety and health personnel when organizing safety and health education and training; 4. the analysis on the current state of enforcing the safety and health education and training and the implementation performance of the recurrent training (return education); and 5. the recommendation options for improving current state and provided as references for the governments and its agencies. By summing up the research results, the identifications and recommendations are as below: 1. On safety and health education and training, the number of contractors that actually conducted the education and training was quite few due to few projects, employer's cost concern, human resource limitations (outsourced training), and time conflict. Moreover, the trainings were done mainly in lecture forms, with giving speeches accounting for the majority; actual rehearsals or drills accounted for the least. 2. The greatest dilemmas faced by self-organized labor safety and health trainings were, in order, the lack of teaching materials, shortage of professional educators, and business being too busy. Thus, it is desired to have the government incorporate safety and health education and training into the compulsory education. The promotion of safety and health education and training shall be initiated from compulsory education. 3. On health personnel's professional knowledge of labor safety, because contractors undertaking small projects account for the majority at the current stage, therefore, in order to reduce costs, the safety and health personnel of some of the contractors are concurrently served by the construction site directors or engineers. The professional knowledge, as a result, only encompasses the routinely updated written information transferred from the full-time safety and health personnel and the tasks assigned by the employer. 4. For the current state of recurrent training, quite few actually executed the recurrent education and training. The loss of manpower and the number of contractual and outsourced workers were not the in the minority. 5. For safety and health education and training courses organized by governmental agencies, they rely on active notifications from the agencies in addition to poster promotions and media advertisements. 6. The government should formulate safety and health education and training manuals based on each industry. Other than defining clearly the professional knowledge and skills for safety and health according to each industrial category, the manuals shall also include each education and training organizing units, summary of the course content, class hours, required qualifications, certificate examination and issuance, methods of recurrent trainings, and contact numbers in order to enable active participation from the workers and enhance their professional skills.
