大陸漁船船員路上安置規定(草案)之檢討與評估

摘要


為顧及漁業發展並解決漁業勞力缺乏問題,行政院於八十二年八月即同意在考量國家安全、漁民生活需求等情況下,漸進式的開放僱用大陸船員;農委會依此政策,先於八十四年七月二十九日公告「臺灣地區漁船船主在臺灣地區離岸十二浬以外海域僱用大陸地區船員暫行措施」,嗣於八十七年二月十八日訂頒「臺灣地區漁船船主接駁受僱大陸地區船員許可辦法」等兩項行政法規,作為我漁船得在臺灣地區離岸十二浬外海域接駁僱用大陸船員參與作業,以及許可彼等隨船進入我海域暫置之依據。然而上述規定實施以來,漁業界未蒙其利反倒衍生諸多海上暴力挾持事件且海上安置措施也造成安全、衛生、人道及國防安全等問題,為改善現況,農委會於九十年十一月八日復研擬一草案(「臺灣地區漁船船主僱用接駁安置大陸地區漁船船員許可及管理辦法」),修正諸多不合理之規定。其中修正最多者為陸上安置管理部分,故有提出討論之必要。本文擬就我國現實僱用大陸船員狀況、衍生之刑事案件為分析並評估有關陸上安置規定,將理論與實務之落差提出討論,作為修法參考。

The shortage of fishermen is a serious problem in Republic of China(R.O.C). The Republic of China(R.O.C) Executive Yuan has in policy permitted the hiring of fishermen from Mainland China ( People's Republic of China)in August 1993. And the Council of Agriculture and the Fisheries Administration then drawn up the administrative regulations in 29th July 1995 and 18th February 1998. These regulations has become the basis of hiring of fishermen from Mainland China.By reviewing the provisions of these regulations, more problem has been ”created” than ”solved”. Practically. Fishermen from Mainland China stay on board out of the 12-mile territorial waters. It caused concerns of the safety, sanitation, humanity and national security, etc. The Council of Agriculture, therefore, drawing up another regulation to solve the problems in 2001. This paper points out the insufficiency of this regulation, the practical conditions of staying-on-board mode and the affiliated criminal act are too serious to ignore and suggests measures of improvement.
