從消費者主權的觀點探討餐飲經營業之責任問題

摘要


「國以民為本,民以食為天」,餐飲經營業是滿足消費者生理需求最直接的場所,隨國民生活素質的提昇,消費群體意識的覺醒,保護消費者權益的訴求,已經變成餐飲經營管理工作的焦點,本篇論文乃試圖從社會責任導向的尺度以消費者主權保障作軸心,藉資解析餐飲經營業的責任問題,進而呼籲業界善盡企業實任,俾能達成消費者與企業經營者問利益均霑的終極目標。本文作者以餐飲經營業所面臨的諸多責任問題為切入點,全篇論文除引言及結論建議外涵蓋:「消費者主權思潮的演變」、「餐飲經營業的民事責任」、「餐飲經營業的刑事責任」、「餐飲經營業的行政責任」、「餐飲經營業的社會責任」、「餐飲消費者權益保障之落實上等六項論題,深切期盼經由理論的推演解析,可以凝聚主管機關、業界與消費者三方面的共識,同心協力一起為餐飲服務業締造一個安全、合理的消費環境。

"A nation regards people as its precious foundation, while the people consider eating as their sublime heaven." Catering business are the immediate sites which provide consumers the satisfaction of physiological needs , In accompanying with the elevation of peoples living quality and the awareness of consumers' conscience, the topics of protecting the right of consumers have become the concerning focus of managing catering businesses. The article attempts to discuss the issue of operating duties of catering businesses, through the application of social responsibility orientation approach. Using the protection of consumer sovereignty as an axis, in order to arouse the circle of catering businesses to pay attention to the importance of business duties. Thus, it hopes to bring the double wins for consumers as well as catering business. The article will discuss the overall issues of responsibilites which catering businesses face today. The whole article includes six aspects: "The evolution of consumers' sovereignty thought," "The civil responsibilities of operating a catering business," "The criminal responsibilities of operating a catering business," "The administrative responsibilities of operating a catering business," "In the social relationship of operating a catering business, "The actualization of the affairs of protecting consumers interest," It expects through the analyses of the above mentioned contents to consolidate the common concensus among government, catering business circle and consumers, to cooperate for constructing a much safer and much reasonable consuming circumstance.
