臺灣省議會職權演變分析（1946-1998）

1946年臺灣省參議會成立，乃至1959年臺灣省議會成立以來，以地方自治為主軸，發揮議政效益，推動省政建設，在中央民代尚未全面改選之前，省議會是重要的民意機關。自1946年省參議會到1998年的省諮議會，臺灣省議會歷經不同時期職權與功能的演變。本研究運用臺灣省諮議會所典藏的數位史料總庫，以及其他既有研究成果，主要探討不同時期省議會的職權，以瞭解臺灣政治、社會演變的過程。根據本文的討論，臺灣省參議會性質雖僅為未享充分議決權的代議諮詢機關，省參議員卻是由人民選出鄉鎮區代表，由鄉鎮區代表選出縣市參議員，再由縣市參議員所間接選出，實具有民意，但僅具建議、詢問與接受人民請願等職權。臺灣省臨時省議會議員既為人民普選產生，為省最高民意機關，但因未取得自治法人資格，是中央政府在省的民意諮詢機關，實際面則具審議省政府預算與提案、對省府各單位與省屬行庫主管有質詢權，提案的質與量比前期提升。1959年，臺灣省臨時省議會正名為臺灣省議會，以合議制方式舉行會議執行職務，是民意機關。1973-1994年時期，反對勢力崛起，對省議會問政的強化與後來臺灣民主開放改革都有一定的影響，此時期省議會之功能亦定位在反映民意與追蹤監督決議案之執行，以及防止政府重大偏失；省議員之職權則為審議行使人民請願處理、提案權、質詢權與審議議決權。根據精省的決議，第一任省長及第十屆省議員任期至1998年12月止，自1946年起的臺灣省議會歷時52年餘，劃下句點，省議員善盡為民請命、為民喉舌的職責，扮演重要的監督角色，也見證一頁臺灣地方自治發展史。

Taiwan Provincial Council was established in 1946 and was dissolved in 1998. It lasted 52 years, was the most important communalistic organization in Taiwan. This organization came over different periods from 1946 to 1998. This study attempted to explore the duties of Taiwan Provincial Council in different periods based on official documents. The duties of Taiwan Provincial Council contain four aspects: 1) Giving advice and suggestion to the government officers about political development. 2) Helping people to petition injustice. 3) Interrogating the administration of the Provincial Government. 4) Adopting the resolution of the budget of the Provincial Government. The Taiwan provincial councilors gave advice and suggestion that influence the direction to the government by joining the education or construction or agriculture or civil administration or finance or traffic committee from 1951 to 1998. Some councilors united together to be a counterforce and became an opposition party later on. Most motions of the councilors focused on public policy and interrogated rationally from 1994 to 1998. Therefore Taiwan Provincial Council and councilors played an important role in Taiwan's politics phylogeny.
