論情報活動的道德爭議與解決之道

情報機關在進行情報活動時，可能遭遇缺乏明確規範、適法性或侵犯人權的爭議，即便在現今的民主法治時代，仍無法完全擺脫此種質疑與困境。本文的目的即在探討情報活動可能產生的倫理道德爭議，分就情報蒐集、情報分析、反情報、秘密行動等分別加以探討，並提出建構新的情報觀點、情報活動適度公開、情報工作法制化、律定情報與政策的互動關係、建立情報監督制度以及追求國家安全與人權保障的平衡等六項改進方法，提供情報機關參考。

When intelligence agencies are undertaking any forms of intelligence activities, there may be lack of the definiteness of regulations, legality or human rights violations while performing the relative intelligence activities. The intelligence activities cannot get rid of such questions and dilemmas even in the democratic and legitimate society nowadays. The study aimed to discuss the possible moral issues of intelligence activities, which divided into 4 aspects such as ＂intelligence collection＂, ＂intelligence analysis＂, ＂counterintelligence＂ and ＂covert action＂, and proposed 6 methods to improve such as establishing a new intelligence perspective, the proper disclosure of intelligence activities, legalizing of intelligence activities, regulating the interaction of intelligence and policies, establishing of intelligence oversight system and achieving the balance between national security and human rights. The conclusions are provided to the intelligence agency for performing the intelligence activity as a reference.
