摘要

本文透過行政失靈的理論建構與命題驗證，用以剖析擴大博愛特區所引發的爭議。由於本案相關職司者在擴大博愛特區的決策過程中，未充分與民眾進行對話與商議，而在面對外界民意的強烈質疑下，臺北市政府最後宣布撤銷公告，而將事件暫劃下句點。回顧擴大博愛特區的事件發展，究其原由係從「限建博愛特區鄰近總統官邸周遭建築物高度」提議開始，爾後議題不斷地發展到要「擴大博愛特區的範圍」，此一決策不僅關係著周遭廣大民眾的權益，更影響未來博愛特區都市發展的面貌，可謂茲事體大。不過，在整個事件中可資觀察的焦點中，初始只鎖定官僚本身內部（總統府及臺北市政府）的溝通及協調問題，而未全盤考量與評估民意趨向，直至意識與覺察到民意的強烈反對後，才作出撤銷擴大博愛特區範圍的決策。至於政策形成的過程，不論結果成功與否，均帶來寶貴的經驗與知識學習，是以，祈藉這個政策個案的探究，縷析背後的原因及產生的問題，並希望在知悉問題的所在後，找到對症下藥，提出診治行政失靈的處方，俾供職司者在面臨重大決策之際，預防與檢視可能的行政失靈，並以之為借鏡，提升與增強治理能力，完善治理績效。

This paper aims to analyze the controversies over expansion of the Boai Special District from the perspective of administrative failure. During the decision-making process of expanding the Boai Special District, the authorities did not hold dialogues and discussions with the public, and in the end the Taipei City Government made an announcement on revoking the directive to close the case temporarily. In view of the development of controversies surrounding the Boai Special District, the issue began with ＂limiting the height of the buildings in the vicinity of the president's residence in the district＂ and developed into ＂expanding the perimeter of the district.＂ The directive would not only affect the rights of the public living near the Boai Special District, it would also alter future urban developments of the district, causing grave consequences. But during the entire process, focus was placed on the communication and negotiation between bureaucratic authorities (the Presidential Office and Taipei City Government), while public opinions were not taken into consideration. Only after perceiving and realizing strong oppositions from the public did the authorities revoke their directive on expanding the district. Any type of decision-making process, whether successful or not, can be a valuable learning experience. It is hoped that by analyzing this individual case, and exploring the causes and problems behind the matter, we can offer solutions to prevent bureaucratic failure, helping authorities to examine and avoid this type of failure when facing with important policy-making decisions, and to enhance their overall governing abilities to achieve positive and effective results.
