「我國」工時縮減暨相關配套措施

Working Hour Schemes and Corresponding Measurements in Taiwan

摘要


近幾年來「我國」勞工長期處於低工資處境,輿論大眾呼籲既然工資無法提高,那就乾脆縮短工時,造成勞工之小確幸。當然工時是否有必要縮短,絕不能取決於工資高低之考量,而應該是正視「我國」勞動實務上是否長期處於長工時現象。鑑於以上各種現實狀況之描述,雖自民國105年縮短週法定工時為每週40小時,已與大部分國家之每週40小時相同,但「我國」年總工時超過2,150小時居高不下,已經造成國人健康之威脅,同時也造成「我國」高工時之負面形象,並容易給予外國貿易不平衡之藉口。為使「我國」勞工之工時趨近合理,以及減少貿易談判之阻礙,縮短法定工時為刻不容緩的課題,也是朝野各界的共識期望。本研究計畫基於上述背景,提出「我國」未來實施縮短工時應有之法規範與做法。

Taiwan has adopted a standard system of weekly working hours, averaging 84 hours biweekly, 42 hours weekly, not far from the standard 40-hour work week of most countries in the world. However, the actual annual total of working hours is 2,150 hours, a number much higher than in other countries. In order to make the standard for working hours reasonable and avoid obstacles to negotiating trading, shortening standard working hours is an urgent issue. People of various circles, both in and out of government, expect some immediate action in revising the standard. To approach for the hours of decent, and to reduce barriers to trade negotiations, shortening the statutory working hours is a pressing issue, but also the government and people of consensus expectations. This research project based on the above background, the future implementation of the proposed law norms and practices of shortening working hours proper.
