當前台灣原住民族諮商同意權與傳統領域劃設的糾葛與突破之道
The Right of Consult and Consent and the Traditional Territories in Taiwan

The elaboration of traditional territories is not the same thing as the practice of the right to consult and obtain. This article argues that the right of consult and obtain has different strengths of management according to different divisions. The exercise of traditional territories and consultations should first clarify their definitions and procedures, and then deal with each other's relationship. In the process of communication and consultation, the consensus among the indigenous peoples should be obtained first, and then meaningful and constructive dialogues with the government and non-indigenous peoples.
