我國憲法增修條文第10條雖已分別明定對於原住民族文化及經濟土地等保障,惟近年來,對於原住民族傳統領域劃設上,實務面有諸多爭議。例如行政院訴願委員會於民國108年2月13日以行政院院臺訴字第1080162600號訴願決定書認為原住民族委員會在程序上未善盡通知義務遽作成劃設傳統領域之行政處分,與原住民族土地或部落範圍土地劃設辦法第10條第2項規定不合,認難謂妥適而撤銷。就原處分及訴願決定等攸關原住民族傳統領域劃設之爭議,容有諸多討論空間。本研究首從原住民族自治權源出發,透過國際法及美國立法例的比較,可以得知我國目前原住民族傳統領域的相關爭點,並透過相關實務案例的解析,知悉現有法制不足及提供主管機關未來認定可以的參考方向。
Although Article 10 of the Amendments to the Constitution has clearly stipulated the protection of aboriginal culture and economic land, there have been many practical disputes regarding the designation of aboriginal peoples' traditional areas in recent years. For example, the Executive Yuan's Appeals Committee issued an appeal decision in 2019, and found that the Indigenous Peoples Committee had not fulfilled its obligation of notification in the procedures, and had made revocation of the original recognition of the traditional field. There is plenty of room for discussion on the disputes concerning the decision. It also affects the future identification procedures for traditional fields. This research first starts from the source of the autonomy of indigenous peoples. Through the comparison of international law and the legislation of the United States, we can learn about the relevant disputes in the traditional areas of aboriginal peoples in Taiwan. Through the analysis of relevant practical cases, we can learn about the inadequacy of the existing legal system and provide reference directions that the competent authority can make better policies and laws in the future.
