撤銷公民國籍、居住安全與民主國家

Denationalization, Residential Security, and Democracies

摘要


加拿大學者Patti Lenard在最近一期的《美國政治科學評論》(American Political Science Review)期刊中發表文章反對民主國家擁有撤銷公民國籍的權力,因為這項權力危及公民的居住安全。本文認為,居住安全並非反對撤銷公民國籍的最好理由,撤銷公民的國籍不必然危及公民的居住安全,特別是當公民擁有雙重國籍時。此外,有些公民如恐怖分子的作為危及其他公民的居住安全,所以民主國家能以保障公民的居住安全為正當理由撤銷恐怖分子公民的國籍。

In a recent article published in American Political Science Review, Patti Lenard argues that democracies should not have the power to revoke citizenship because this power jeopardizes citizens' residential security. In this article, I argue that residential security is not the best reason to reject the power to revoke citizenship. Revoking citizenship does not necessarily endanger citizens' residential security, especially in the case of people with dual citizenship. Moreover, given that some citizens such as terrorists threaten other citizens' residential security, the protection of residential security constitutes a legitimate reason to revoke terrorists' citizenship.
