警政貪瀆犯罪型態及其防治策略

摘要

警察職務相當繁雜，依警察法第九條：「警察依法行使左列職權：一、發佈警察命令。二、違警處分。三、協助偵查犯罪。四、執行搜索、扣押、拘提及逮捕。五、行政執行。六、使用警械。七、有關警察業務之保安、正俗、交通、衛生、消防、救災、營業建築、市容整理、戶口查察、外事處理等事項。八、其他應執行法令事項。」因此，常與民眾的利益相衝突，致其職務涉及貪瀆犯罪有一定的比例。本文先從宏觀的角度切入貪瀆犯罪，再整理出警政貪瀆犯罪型態，同時，也分析具體個案，希望從中找到防治策略。歸究其主因，主要是專業人員對於法律倫理的疏離，並非法律不備或專業不足，回歸法理倫理思考，建立適當的法律倫理，訂定合理的規範或行為準則乃當務之急，現行貪瀆犯罪之刑事立法趨勢，走向嚴懲化的思考，貪瀆案件仍層出不窮，或許，回歸公務員倫理思考，才能達到有效防制貪瀆犯罪。

Police duties are quite complicated, according to the article 9 Police Act: The police exercise the following duties according to applicable laws: 1. Release of police order. 2. Penalty for violating a police order. 3. Assistance in crime investigation. 4. Perform searches, seizure, and arrest with a warrant and arrests. 5. Administrative enforcement. 6. Use of police weapon. 7. Public order maintenance, vice control, traffic, disease control, fire service affairs, disaster rescue, special business, illegal construction business establishments, clamping down on environment polluters and illegal vendors, household visitation, and foreign affairs that require involvement of the police. 8. Other matters enforceable according to applicable laws. Therefore, their duties are often in conflict with the interests of the people, causing their certain proportion of involvement in the corruption crimes. This paper begins with a macro point discussion in the corruption offense, then sort out the corruption police crime patterns, and analysis of specific cases, hoping to find a prevention strategy. The main cause of their corruption is primarily their alienation of professional ethics, not a legal or professional deficiency. Our priority is to return to the legal ethical thinking, to establish appropriate legal ethics, to set appropriate standards or codes of conduct is a priority. Current legislation seeks to give the corruption crime criminal a harsher punishment, but the corruption cases are still emerging. Perhaps, we should return to ethical thinking of civil servants in order to achieve effective prevention and control the corruption crimes.
