警察人員涉貪風險成因分析

The Structural Factors of Police Corruption

摘要


本文採用制度理論的取徑,試圖回答兩個問題:第一、警察貪污之結構原因為何?第二,如何能夠遏制警察貪污的結構?本文先回顧過去近40年相關文獻,系統分析文獻對預防員警貪污中提出的「對策」。其次,本文訪談與此以議題相關當事人共27人(因案服刑員警、現任官警、警政改革團體代表、媒體、特種行業者、檢調人員等),據此分析出結構因素後,再以四場焦點座談會議(共24人)驗證訪談內容分析之結果,本文發現,警察貪腐敗之結構因子有「組織鐵三角」的問題,鐵三角是「續效、財務、白手套」,核心是代間相傳的慣習與倫理,使得貪污結構持續。根據此發現,本研究提出「員警收賄階梯論」,並以此理論作為政策制訂者未來擬定預防警察人員貪污對策之參考。

Inspired by neo- institutional theory, this article aims to answer two questions. First, what are the structural factors of police corruption? Second, how can police corruption be stopped? The article first reviews corruption literature from the past 40 years, systematically analyzing proposed prevention methods. Then it progresses to assessing interviews with convicted police officers, prosecutors, and bribers as well as representatives from police reform groups and the media-assessing 27 groups in total-to analyze the structural factors of corruption. The results are further verified by 24 experts from focus groups. The main finding in this research is that the organizational triangle-including information passed down from the three "triangle" entities KPI, informal finance, and the white glove-has generated the habitus of corruption. Based on this finding, this study proposes the concept of the police corruption ladder, which could serve as a reference for policy makers in formulating countermeasures that can prevent police corruption in the future.
