從國家與社會關係析論兩岸對民間組織法制建構之比較研究

A Comparison Study on the Laws and Regulations of NGOs across the Taiwan Strait from Perspectives of the Relationship between Government and Society

摘要


本研究旨在從國家與社會關係析論兩岸對公民社會建構的建立,從兩岸民間組織立法制度分析比較,以梳理兩岸民間組織蓬勃發展的異同點。臺灣自1987年政府宣布解嚴30年來,政治制度從威權體制轉型為民主體制,憲法賦予人民有結社自由的基本權利終於獲使得鬆綁,使得民間組織呈蓬勃發展景象,將臺灣形塑成一個公民社會的社會;而中國大陸亦自1978年改革開放近40年來,即使在政治制度上仍採中央集權,惟受全球結社運動興起的影響,民間組織在1990年代之後亦呈現爆發性的成長。為因應民間組織蓬勃發展的事實與影響,兩岸政府分別制定各種法規予以規範,使其能在制度內有所遵循,不致逾越法律規範,並期待這股力量能成為政府與民間溝通的橋梁,能在政府與企業之外一個安定社會的力量。

Since the lifting of Martial law by the government in 1987, the political system in Taiwan had completed a transition from authoritarian to democratic. That released Taiwanese people from organizing associations, which the fundamental right given by our constitution. Now, the development of non-governmental organizations (NGOs) in Taiwan is flourishing to form a real civil society. On the other hand, China still adopted a centralized political system for nearly 40 years, even after "Reform and Opening Up" in 1978. Nonetheless, under the influence of the global associational revolution, there had been a vigorous growth of in China after the 1990s. In response to the development of NGOs, laws and regulations implemented in Taiwan and China have to be amended to supervise NGOs. The purpose is to offer the guidelines for NGOs -the third sector to follow and empower them to be the bridge between government and civilians for our society as the power of stability.
