研析臺灣海峽海域武力運用的國際法原則

摘要

臺灣海峽目前在國際慣例上屬「用於國際航行的海峽」，而國際法海權概念中的「船舶無害通過」及「公海航行自由」理論，牽動著海戰行為的規制，「海軍及軍艦」，更是主宰國家領海主權維護的關鍵角色。又兩岸所簽訂的「海峽兩岸海運協議」國際法文件，涉及了領海及國家安全議題，海軍必須要有「依法用兵」的思維，同時軍事合作是一種軍事利用的思考。
