矯正機關全面開放異性戒護勤務之影響評估研究

摘要


有關我國監獄官及監所管理員考試,是否能夠取消分定男女錄取名額,以保障現行錄取名額較少之女性工作權,乃是性別平權思潮下的重要議題。為瞭解此一政策的可行性,本文藉由文獻探討、深度訪談及焦點團體座談等方式蒐集資料,加以分析我國矯正機關人力運用、戒護勤務內容,以及未來如矯正機關全面開放異性戒護可能之衝擊與相關配套措施。主要研究發現有六:一、目前我國矯正機關戒護人力不足造成勤務負擔過重,合理的戒護比至少應降至1:6至1:8之間;二、以勤務小組共同服勤方式可提升戒護人員異性戒護的意願;三、男性/女性戒護人員不願意擔服異性戒護的主因不同;四、目前9成以上的近身戒護勤務,仍應由相同性別之戒護人員執行戒護勤務。五、全面採行異性戒護衝擊大,應有配套措施後再實施為宜;六、異性戒護對監所管理員的影響較監獄官明顯。根據研究結果,本文提出七項研究建議:一、加強戒護人員性別意識,提升友善職場文化;二、改善並充實現有裝備,以提高戒護人員執勤安全;三、補足戒護人員預算員額數;四、規劃合理工作時數與勤休制度;五、相關法規應配合修正;六、引進科技設備輔助戒護需求;七、從勤務單純的矯正機關或勤務內容試辦異性戒護。

For the protection of the working rights of women, the cancelation of the quotas for male and female admissions in the examination of prison officers and prison administrators in Taiwan has become an issue under the trend of gender equality. In order to understand the feasibility of this policy, this study collects data through literature discussion, in-depth interviews, and focus group discussions, and analyzes the manpower utilization and the content of the guard duty of correction agencies in Taiwan. There are six major research findings as followed: 1. The lack of manpower in correctional agencies causes excessive burden of duties. A reasonable ratio of treatment should reduce to between 1:6 and 1:8. 2. The joint service of duty groups can be used to increase the willingness to guard the opposite sex. 3. The main reasons of unwillingness for guarding of the opposite sex between male and female guards are different. 4. Currently, more than 90% of close guard duties should still be guarded by the same sex. 5. Because the full adoption of heterosexual guarding may result in a great impact, it is advisable to provide supporting measures when implementing. 6. The impact of heterosexual guarding on prison administrators is more obvious than prison officers. Based on the research results, this study puts forward seven research recommendations: 1. To strengthen the gender awareness and to promote a friendly workplace culture. 2. To improve the current equipment to increase the safety of guards on duty. 3. To supplement the budgeted number of staff members for guards. 4. To plan a reasonable system for working hours and off-days. 5. To revise relevant laws and regulations. 6. To introduce scientific and technological equipment to assist the needs of guarding. 7. To pilot trials on guarding of opposite sex.
