On the Realization of Debt to Equity Swap in The Pledge Financing of New Plant Varieties

摘要

With the implementation of the strategy of strengthening the country with intellectual property rights, the state attaches great importance to the use of intellectual property rights. As a new type of intellectual property, the right of new plant varieties has been paid special attention by the state. The right of new plant varieties has been applied under the strategy of strengthening the country with intellectual property rights. The way of pledge financing can make the property value of new plant variety rights. However, there are some problems in the way to realize the right of financing by pledge of new plant variety right. Therefore, enterprises are facing the problem of financing by pledge of new plant variety rights. The key to solving the financing difficulty lies in innovating the way to realize the financing qualification right by pledge of new plant variety right, solving the financing difficulty of enterprises by means of debt to equity swap, and ensuring the interests of banks to achieve a win‐win situation.
