論「中央專屬權」委辦化在「兩岸交流」應用之可能性-兼論兩岸地方政府權限之比較

摘要


「兩岸交流」依《憲法增修條文》及《臺灣地區與大陸地區人民關係條例》之規定,實屬「中央專屬權」。由於經社需求與政治定位間之違和,兩岸交流已出現諸多窒礙。本文發現,透由「委辦」手法,便可解決上述問題。亦即,只要將現行所有之「委辦」法制理論與實務,套用在兩岸事務上,由地方來辦理中央之專屬事項,係完全可能。凡此,實屬我國在兩岸交流之另一「進步」。

According to the "Additional Articles of the Constitution of the Republic of China" and the "Act Governing Relations between the People of the Taiwan Area and the Mainland Area", the authority of Cross-strait exchanges belongs to the central government exclusively. However, the differences between social economic demand and political positioning cause the stumbling of Cross-strait exchanges. This article discovered that through the delegation of central government exclusive authority could solve the problem above. Namely, put the current delegation theory into practice in Cross-strait exchanges. It is totally possible that the central government delegate the local government to handle Cross-strait exchanges affairs. Therefore, it is another great progress for Cross-strait exchanges in our country.
