文資法賦予縣市政府種種的政策工具來保護考古遺址。但何以法令齊備且已審議通過,而主管機關仍對考古遺址指定公告與保存有所遲疑與延宕呢?我們宜暫時跳脫氣憤與抗爭的激情,而以「社會想像/地方知識」此組另種議題與角度來重新思考為何看似完備的文資法卻無法落實保護考古遺址。社會的集體想像與社會價值建構互為表裡,而以法律的形式來制度化與具象化。法律作為一種社會想像/原則/社會連結等的再生產,具有高度的在地性,而為不折不扣的「地方知識」。若將文資法以「地方知識」的角度來思考,則當我們希望將某個考古遺址指定或登錄為法定文化資產時,不僅需將其描述與再現為如何地符合文資法,更需動員種種文化資產知識、建構文化資產的豐富度、落實文化資產知識有效性等,以符合所處時空脈絡中的社會想像。
The Cultural Heritage Conservation Law provides lots of policy tools to protect archeological sites. However, even though a cultural heritage examination committee may have approved an archeological site, local government does not always issue the necessary proclamation. Why is this? I suggest it is more constructive to examine the reasons why the law cannot protect archaeological sites wproperly from the viewpoint of "social imagination and local knowledge" issues, rather than to engage in angry debate. Social imaginations and social values produce each other and embody themselves in laws. Being a product of social imaginations, rules, and social relationships, laws are some kind of local knowledge. Since the Cultural Heritage Conservation Law is one kind of local knowledge, when we want to promote the official status of an archaeological site, we not only have to present how this archaeological site fits the criteria of the Cultural Heritage Conservation Law, but also we have to mobilize lots of cultural heritage knowledge, enrich the cultural contents of the site, and effect the knowledge, in order to coincide the social imaginations in the social context.
