《中华人民共和国妇女权益保障法》与地方实施办法的互动
On the Interaction between the National Law and Local Implementation Regulations on the Protection of Women's Rights and Interests
摘要
《中华人民共和国妇女权益保障法》是我国保护妇女权益的基本法，其上接《中华人民共和国宪法》规定的保障人权、男女平等、保护妇女等宪法理念，下启各省、自治区和直辖市的《中华人民共和国妇女权益保障法》实施办法，形成国家法律→地方法规→妇女权益保障实践的适法链条。近年来，地方立法积极创新，表现出鲜明的综合性、操作性、本土性和前瞻性，但囿于上位法固有的历史局限，在框架结构和规则机制方面受到一定的辖制，渐已形成倒逼国家法省思和完善的态势。于此之际，反向梳理妇女权益保障实践→地方法规→国家法律的传导链条，将实践中产生的制度需求精准反馈至国家立法层面，将地方立法经验及时转化为国家法律修改的经验借鉴，对《中华人民共和国妇女权益保障法》的价值理念、篇章架构和法律规范进行体系化重构和优化，是完善妇女人权法治的重要路径。

In China, the Law on the Protection of Women's Rights and Interests is the basic law in this field. It is the concretization of the legal concepts of equality, human rights and the protection of women stipulated in the Constitution. Meanwhile, it is launched into the implementation measures in provinces, autonomous regions and municipalities directly under the central government, forming a legal chain of the national law→ local regulations→ women's rights and interests protection practice. In recent years, local legislation has been actively innovated, showing distinct comprehensiveness, operability, localization and foresight. However, due to the inherent historical limitations of upper level law, its development and innovation are limited under the ceiling in terms of framework structure and some mechanisms, which has gradually formed a trend to push national law to introspect and improve itself. At this time, reverse sorting out the transmission chain of women's rights and interests protection practice→ local regulations→ the national law, accurately feeding back the institutional requirements generated in practice to the national legislation level, timely transforming the experience of local legislation into the experience of national law revision, and systematically reconstructing and optimizing the value concept, chapter structure and legal norms of the women's law are important ways to improve and perfect the rule of law on protection of women's human rights.
