论当代中国的人权学科

On the Human Rights Discipline in Contemporary China

摘要


当代中国人权学科是不以人们的主观意志为转移的客观存在,尽管在不同的学科领域表现形式有所差异,但尊重和保障人权的价值取向贯穿在人权学科与这些学科的交叉领域之中。当代中国人权学科的发展过程经历萌芽、初创、发展三个历史阶段。从发展内涵来看,人权研究与人权教育是当代中国人权学科的重要支点,党和国家政策法律文件是当代中国人权学科的重要基础,国家人权教育与培育基地在当代中国人权学科发展中发挥了重要的示范和引领作用。从动因来看,当代中国人权学科发展是多种因素相互作用的结果,主要包括人权政治化的严峻挑战、全球人权治理改革的迫切需要、中国人权事业发展进步的内在需求。成立人权一级学科是当代中国人权学科发展的必然趋势。目前成立人权一级学科的基础条件、基本范畴已经形成,应当适时推动设置人权一级学科。

The human rights discipline in contemporary China is an objective existence that does not depend on people's subjective will. Although it manifests itself differently in different disciplines, the value of respecting and safeguarding human rights permeates the intersection of the human rights discipline and other disciplines. The development of the discipline of human rights in contemporary China can be divided into three historical stages: budding, incipient and development. In terms of connotations, human rights research and human rights education are important pivot points of the human rights discipline in contemporary China; policy and legal documents of the Party and the state are important foundations of the human rights discipline in contemporary China; and national human rights education and cultivation bases have played an important role in the development of the human rights discipline in contemporary China. In terms of motivations, the development of the human rights discipline in contemporary China is the result of the interaction of many factors, mainly including the serious challenge of the politicization of human rights, the urgent need for global governing and reforming human rights, and the inherent need for progress in the development of China's human rights cause. The establishment of a first-level discipline in human rights is an inevitable requirement for the development of human rights disciplines in China. The basic conditions and basic categories for the establishment of a first-level discipline in human rights have already been formed. Therefore, the establishment of a first-level discipline in human rights should be promoted in due course.
