摘要

依道路交通管理處罰條例第三十五條規定，對於酒醉駕車行為，有明文處罰之依據。警察之執行上，其職權應如何行使，亦有一定判斷空間。依實務之作法，會採取針對一特定時間內、對經過某一路段之車輛，採取全部攔停作法之方式。從理論上而言，其是否符合作用法律授權之要件；另相關酒測之要求與制裁，是否符合法治國家原則，亦有探討之空間，此為本文主要重點。
