人民參與審判制度下的刑事鑑定—以日本裁判員制度下的責任能力判斷為探討核心

摘要

人民參與審判是司法院在這幾年極力所推動的制度，只是此制度從一開始以觀審名之，卻在輿論壓力下，又再更名為人民參審，已足以顯示制度推動的倉促性。比鄰之日本，為了裁判員制度的實施，而至少有十年的準備時間，在實施五年多後，仍出現不少問題，顯見，制度推動絕對是百年大計，致不能只是急就章。本文即從日本裁判員制度實施後，關於精神鑑定所出現的問題，來凸顯此問題。
