取締酒後駕車實務之探討

Probing into the Practice of Clampdown on DUI

摘要


我國對於酒後駕車之執法依據,主要為《道路交通管理處罰條例》第35條第1項酒後駕車、第4項拒絕接受檢測之行政罰責,以及《刑法》第185-3條公共危險罪之刑事罰責;而警察機關在執勤面向上,內政部警政署亦訂有「取締酒後駕車作業程序」,以供執勤人員遵循。雖然大多數執勤人員皆能依照前述法令及作業程序落實執勤,然由行政判決可知,仍有少數執勤人員於執行取締酒後駕車勤務時,因不熟悉取締酒後駕車之法定構成要件與作業程序,或出於便宜行事等因素,進而衍生諸多執法爭議,甚至威脅員警之執勤安全等情事。因此,本文以取締酒後駕車相關法令為基準,探討取締酒後駕車實務之作法,以及可能產生的執勤盲點,最後,針對執勤時「書面紀錄之運用時機」、「實施酒精濃度測試時之權利告知與錄影」、「酒測濃度與裁量處置」,以及「強制檢測之時機」等四點,提出結論與建議,希能強化執勤人員對於攔停要件以及相關程序之瞭解及重視,進而發揮執法之功效。

The law enforcement basis for driving under the influence (DUI) of our country is based on paragraph 1(DUI), paragraph 4(Rejecting Sobriety Test), Article 35 of the "Act Governing the Punishment of Violation of Road Traffic Regulation", and Article 185-3(Offenses Against Public Safety) of the "Criminal Law". National Police Agency, Ministry of the Interior has also formulated the "Standard Operating Procedure for Clampdown on DUI" for police personnel on duty to follow. Although most police officers can perform their duties in accordance with the above-mentioned law, regulation and the SOP, the administrative judgements show that there are still a few police officers who are not familiar with legal elements and the SOP. That will make many controversies in law enforcement, and the safety of the police personnel on duty has even been threatened. Therefore, this article uses the laws and regulations related to the clampdown on DUI as a reference, and discusses in current practice in actual operations and possible blind spots of clampdown on DUI. Lastly, it focuses on the "Timing of the Written Record of Use", "Declare Rights and Film while Sobriety Test", "Alcohol Concentration and Discretionary Power" and "Timing of Conducting Mandatory Detection". These four subjects should strengthen police officers' understanding, attention to the elements of pull one's over and related procedure, and then play the role of law enforcement.
