Governance of Higher Education Towards Academic Excellence: A Review of the University and University Colleges Act 1971

The symbiotic relationship between the Ministry of Higher Education and Malaysian public universities is based on the formal administrative jurisdiction, either explicitly or obliquely on the latter. Fundamental to this relationship are the stipulations in the University and University Colleges Act (UUCA) 1971. This article examines this special relationship and its impact on university governance and autonomy with a view to explore the potential for meaningful reforms of the University. Under the 1971 Act, the Minister of Higher Education not only determines the strategic road map for higher education and budget allocation but also the appointment of the university's management including the board members as well as the vice chancellor and deputy vice chancellors. The application of the Act during the last five decades has created a number of implications affecting university governance and autonomy. In view of the current challenge and the need for academic excellence, a review of the 1971 Act is deemed appropriate and timely. In this context, the Higher Education Council Act 1996 should be leveraged upon to create long lasting reforms to include the autonomy to select the top university management as well as the introduction of a new university remuneration scheme different from the existing public sector scheme.
