The scope of this study mainly focuses on the specification of the drug injury relief system, which mainly involves the legal disputes of "common and predictable adverse drug reactions" in the "drug injury compensation system" for reasons of non-relief. The so-called dispute is limited to the analysis of whether the "principle of proportionality" and the "principle of clarity" stipulated in Article 13, paragraph 9 of the Drug Injury Relief Law are violated to clarify the legal concept. The author firstly discusses the norm of the drug injury relief law, and explains the actual implementation procedure of the drug injury relief law. Secondly, sorts out the controversy over the clarification of the legal concept in the above-mentioned "common and predictable adverse drug reactions". In order to focus on the core of the research, the author mainly uses academic journals and interpretations of the justices as the research materials, and chooses the " Principle of proportionality" and the "principle of clarity" to make comparative analysis.
