政府本應依1995年《公寓大廈管理條例》之規定追溯既往,強制規定未成立管理組織的公寓大廈成立管理組織,卻因執法功能不彰,導致條例頒布後仍有許多老舊的公寓大廈未成立管理組織,造成政府現今管理上之困難,因此本論文於第一階段選定都市化程度較高的臺北市,於社區發放問卷詢問社區居民未成立管理組織之關鍵因素,歸納出政府可行之解決對策來提高民眾成立管理組織之意願,第二階段再以AHP層級分析法問卷分別發放給相關領域的專家跟民眾填寫,並召開專家研討會與個人訪談討論分析出之權重結果。本研究認為提高誘因、增加不願成立管理組織之社區所需負擔的成本與成立管理組織後的輔導與陪伴機制為提高民眾成立管理組織意願的三大重點,提高誘因包括整合各部門補助、統一政府各部門補助政策、減免房屋稅、檢討成立管理組織之程序、優化網站內容和持續推動輔導成立管理組織計畫,增加負擔成本除了現有法規加以處罰與不分管理組織成立與否加強執行法規或課徵房屋稅,或將未成立管理組織納入條例罰則,輔導與陪伴機制則是由政府提供管理維護專業課程,為管理委員提供專家諮詢服務或在地輔導,來協助社區住戶降低成立管理組織前後的交易成本,以提升老舊公寓大廈公共設施的管理維護品質。
Although old residential buildings are obliged to establish management committee according to retrospective Condominium Regulation Act Building Administration Division enacted in 1995, laws are not fully enforced by government, cause many existing old residential buildings don’t establish management committee and become government’s difficulties on management. This research first distributed questionnaires to communities among Taipei City, a highly urbanized city, to investigate inhabitants the key reasons for lacking management committee, and provided strategy for resolution to increase inhabitant’s willing to establish management committee, and distribute AHP survey for both experts and inhabitants, then discuss the priorities for alternative’s decision through AHP analysis with expert seminars and individuals’ interviews. The conclusion believes raising incentives, increase the cost for those communities unwilling to establish management committee, and providing professional counseling after the establishment of management committee are three key resolutions to increase inhabitants’ willing to establish management committee. Raising incentives includes combining subsidies from different government’s department, unify different department’s policies, house tax relief, review the procedure of regulations for establish management committee, website improvement and continue the counseling plan of management committee establishment for old residential buildings. Increasing the cost includes punishment by existing regulations, old residential buildings with or without management committee shall all be regulated by law in practice, house tax increase, or add penalty in penalty provisions. Providing professional counseling includes providing classes related to facility management, expert counseling for management committee and local counseling, to decrease inhabitant’s transaction cost for establishing management committee so that the quality of facility management among old residential buildings can be improved.
