市場化中政府監管之重塑：中國大陸醫院體系研究

摘要

近年來，在中國大陸社會中存有「看病貴、看病難」的情況，甚至更出現天價醫療費用的案例。公立醫院給予外界的印象是提供合理且親民價格的醫療服務，且中國目前的醫院體系中公立醫院占有相當大的比例，然在中國卻發現公立醫院如同私立醫院般以追求利益為第一考量，甚至引發了看病貴與看病難之情形。
本論文將以監管的角度檢視政府在醫院體系中一系列的監管政策，從醫院的准入，及其伴隨而來的財稅政策與價格政策，可發現政府在監管公私立醫院間存有差別化之政策。緊接著，將探討政府對於公立醫院營運之監管情形。最後將檢視政府對於醫院收費方式的規範以及醫師開立處方行為的規範。
本文發現公私立醫院的差別化政策並非因公立醫院俘虜政府部門而導致，而係政府於權衡各方利益後於現階段呈現出來的結果。而監管機構在執行監管上，也因其管辦不分的角色，在對待公私立醫院上有偏頗之嫌。最後，政府在醫院與醫師行為的監管規範尚有不足，使得被監管者未因畏懼懲罰進而遵守規定。

In recent years, the existence of expensive medical bills and difficult access to quality medical services are growing worser in the Chnia. The image of public hospitals is providing reasonable and afforadble medical services to the public. However, the problem of inadequate and costly medical services in China does not find the solution by the high coverage of public hospitals.
By analysing a series of regulating policies about hospitals, from the admittance into the market, the fiscal and taxation policies and the medical service price policy. The existing situation is that government implement differential policies between public hospital and private hospital. Furthermore, the author explores that how the government regulating the operation of public hospital. Finally, the author examines the regulation of the charging fee from patients and prescribing prescription behavior by hospitals and physicians.
It comes to conclusions. First, the author finds that the government implements the differential policies between public and private hospitals as the result of balancing the interests of all interested parties, not resulting from the public hospitals capturing the department of government. Second, the regulating agency plays a role of player and also a referee at the same time. It is doubtful to people that whether the regulating agency is fair or not. Finally, the penalties are not comprehensive and severe enough for the hospitals and physicians to obey.
