美麗島事件辯護律師團之研究

摘要

美麗島事件之所以在戰後臺灣民主運動中佔有重要的地位，除了它是距二二八事件三十年後，本土反對力量再一次的匯集外，參與本事件軍法大審之辯護律師團成員日後在政壇上的表現，亦使該事件之重要性更加提升。
檢視辯護律師團成員之學經歷背景，可發現參與「比較法學會（即今臺灣法學會）」與就讀「臺灣大學法律學院」之背景與參與辯護律師團之運作有極高之關連性，其緣由當與該學會之人際網絡及臺灣大學法律學院之自由學風有關。
復因美麗島事件各被告實具有共同正犯之關係，故各辯護律師在辯護策略之選擇上亦採針對所有共同被告一同辯護為原則，至其細節可放在「政治/法律辯護」及「事件/當事人辯護」等二脈絡下來檢視。
辯護律師團之成員有些現仍持續在臺灣政壇上發光發熱，有些則退居幕後，從事與其志趣相符之社會運動，本文暫不擬對其等之功過蓋棺論定，僅從時間之先後順序，對辯護律師團在戰後臺灣民主運動上，訂下：上承「美麗島世代及受刑人家屬」，下啟「學運世代」之時間座標。

Besides the Formosa Incident is the native opposition strength reunites once again after the 228 event 30 years before, the defense attorneys who participate in the Court Martial have great influence on Taiwan’s politics is also the reason that the Formosa Incident holds an important status on the postwar democratic transition in Taiwan.
After inspection on the backgrounds of the defense attorney members, we discover that the membership of the “China Society of Comparative Law” (renamed as Taiwan Law Society, hereinafter the Society) and studying in the College of Law, National Taiwan University (hereinafter the NTU Law) have extremely high correlation with taking part in the defense attorneys. It concerns with the interpersonal network of the Society and the liberal ethos of the NTU Law.
Because all defendants are so-called conspirators, the defense attorneys chose the defense strategy under the principle of ”defense in common”, and the “politics/law defense” and the “event/litigant defense” are two main defense strategies in details.
For the time being, members of the defense attorneys some continue playing pivotal roles in Taiwan political arena, others step down secretly, still others are engaged in social movements which match their interests. This research does not plan to make the final judgment on the merits of the defense attorneys. On the contrary, looking back at the history, we temporarily get the conclusion that the defense attorneys link “the Formosa Incident generation & their families” and “the student movement generation” on the postwar democratic transition in Taiwan.
