論國家管制人民遷徙自由的界限－以我國公務員赴中國大陸管制規範為中心

隨著兩岸交流熱絡，人員往來日趨頻繁。鑒於兩岸關係特殊，有關政府管制公務員前往中國大陸管制規範，向為學術界與實務界關注的課題。此一課題，不僅涉及憲法保障人民遷徙自由的基本權，亦涉公務員與國家的關係。本文以憲法學的角度出發，在比較研究上，經由考察遷徙自由學理、不同國家管制法制及模式，並就遷徙自由的違憲審查標準，尋繹相關原理原則，檢驗相關規定是否具合憲性，並指出我國管制規範與現實的落差。同時，思考如何在確保國家安全與因應特定層面交流的殷切需求，訂定一套合憲的管制規範，並提出具體解決之道及建議方向，提供相關單位參考。

With the warm cross-strait exchanges, personnel exchanges become more frequent. In view of the special cross-strait relations, the government control of civil servants to Mainland China regulations, to the academic and practical concern. On this subject, not only the people involved in the constitutional guarantee of the basic right to freedom of movement, but also related to the relationship between civil servants and the State. In this paper, the view of constitutional law, in the comparative study, through the relevant principles testing whether the study of free movement, the rule of law in different countries and mode of control, and review of free movement of the Standards of Judicial Review standard. Then, point out that Taiwan's control of the gap between norms and reality. At the same time, think about how to ensure national security and response to the strong demand of specific aspects of exchange, for a set of constitutional norms of control and put forward solutions and recommendations providing to relevant units reference.
