摘要

國家公園是目前自然保育及維持生物多樣性重要的方式之一，為野生動植物的重要棲所，國家公園設置有助於生態系統穩定發展，提供臺灣特有動植物及瀕危物種復原的最佳場所，透過有效的保護管制與經營使用，並藉由適當的土地分區管制，來保護國家公園特殊自然景觀與生態環境，提供國民從事學術研究及休閒遊憩。
本論文主要探討臺灣國家公園署之定位及其組織目標，並探討現行國家公園法應如何修正。透過整理國家公園相關文獻、臺灣現行國家公園相關法令及國家公園組織，探討成立背景與功能，參考外國國家公園制度與實務上發生之國家公園事件裁判，以補現行條文不足之處，以期達到國家公園保護國家特有之自然風景、野生動植物及史蹟，並提供國民育樂及研究之宗旨。

National parks are one of the most important ways to conserve and maintain biodiversity, and also important habitat for wildlife. The establishment of national parks contributes to the stable development of the ecosystem and provides the best place for the restoration of Taiwan's endemic and endangered species. Through effective protection regulations and management, and through appropriate land zoning control, the special natural landscape and ecological environment of national parks will be protected, and citizens will be provided for academic research and recreation.
This thesis mainly studies the positioning and organizational goals of the Taiwan National Park Service, and discusses how the existing National Park Law should be amended. By reviewing relevant literature, laws and national park organizations. Referring to foreign national park systems and domestic adjudgments. To achieve the goal of protecting special natural scenery, wildlife and historical sites.
