地方政府未達公告金額採購機制之研究─以桃園縣轄為例

政府採購目的，係以合理價格獲取高品質之商品或服務；政府採購特色並非追求最大商業利益，而是著重於增進最大公共福祉為依歸；基於市場公平競爭原則，在我國加入世界貿易組織後，依據政府採購協定開放政府採購市場給締約國家，以建立公平、公開與促進良性競爭的採購制度。
實施中的政策，必須檢討評估適時修正調整，以符合環境需要，採購法實行以來站在地方政府的立場加以探討，驗證現行政府採購法規設計機制下，桃園縣轄各機關學校，依法執行採購後，其法規是否週全、程序是否簡化、弊端是否改善、品質是否確保、效率是否提升、達到政府採購公開的實質效益。
藉由相關法規文獻探討、採購態樣實務分析、採購人員問卷調查、深入訪談等方式，以瞭解採購法實行後，政策執行所顯現之效能，並發現缺失與所遭遇的問題，尋求解決建議方案。在採購類型多元化的今天，在不妨礙公平競爭原則下，賦予地方政府自主權力，對採購方式裁量之彈性空間，不但有助於採購效能提升，亦有利於地方自治精神的落實。

ABSTRACT
The purpose of the government procurement is based on the reasonable price to obtain the goods and service with high quality. The key feature for government procurement is not seeking for the best business profit but in view of the fair market competition principle to emphasis on how to enhance the public benefit. In addition, as we join in the WTO association and follow the agreement on government procurement accordingly. To build the impartial, disclosure and virtuous competition procurement system we open government procurement market to those countries have conclude with.
The existing policy has to be evaluated and modified and more applicable on circumstance needs.
In view of the local government this research not only review on the policy but also experiment on the current implementation on the different level of schools and institution of the Taoyuan County. To verify whether the rule is completed, process is streamlined, abuse is improved, quality is ensured and efficiency is moved up and then to reach the substance benefit on governmental procurement on public.
Underlying the approach of the relational literature, procurement essential example analysis, questioner survey and depth interview on purchasing people. Thus, knowing the significant effectiveness after the procurement policy implemented. Finding the deficient and problem then looking for the solution.
In the present age local government facing the more diversified society. To have better efficiency and flexible on procurement process we suggest empower the local government’s power on government procurement policy.
