基層公務機關行為腐化與防治策略之研究--以桃園市公所為例

摘要


近年來國內相繼發生多起重大貪污案件,造成國家形象嚴重受損及國家競爭力之下降。公元2000年民主進步黨以『政黨輪替,掃除黑金』為訴求,嬴得總統大選;公元2001年5月美國貿易代表署首度將台灣之貪污現象列為貿易障礙,更突顯我國澄清吏治、端正政風之迫切性。 本研究以基層公務機關工程、採購、地政、建管、工商登記、環保衛生等易滋弊端事項為研究對象並就桃園市公所防治腐化之策略設計與績效略加評析,輔以若干先進國家或地區(如美國、日本、香港、新加坡、南韓等)之防治貪污腐化之法律及制度等加以比較研究,以歸納出各種制度之利弊得失,作為我國制定廉政政策之參考。   本研究發現:一、先進國家或地區之廉政經驗值得我國借鏡,例如,香港及新加坡之肅貪組織及各種防貪措施;二、我國目前肅貪機構事權不統一,似宜加以整合,以提升整體功能;三、部分肅貪防貪之法律及行政規章有待修改,期能落實防弊功能;四、民眾對肅貪普遍存有冷莫感,因此宜加強民眾法紀教育宣導,建立全民共同監督之機制,才能有效澄清吏治。 本研究建議:一、貫徹執法以檢肅貪瀆。二、發揮審計稽核功能以導正財務上不忠、不法之行為。三、加強政風人員專業講習訓練。四、修改政府採購法之最有利標評選制度。五、落實財產申報制度。六、貫徹公務人員職期輪調制度。七、樹立道德與法治觀念。八、成立專責之肅貪機構。九、執政者須有肅貪決心。

Recent years many severe corruptive cases continuously happened, seriously damaged our national reputation & descended national competition. Democratic Progressive Party claimed for “Party Replacement, Sweeping Corruption” and won the presidential election in the year of 2000. American Trade Representative Bureau first declared Taiwan corruptive condition for trade hindrance in May of 2001, this especially appeared the urgency to prevent government official for covetousness and to clean our politic custom. This research is focused on the basic official organization of engineering, purchase, land administration, construction administration, industrial & commercial registration, environmental protection & sanitation that may easily be corrupted, and used Taoyuan City Hall as an example to evaluate & analyze its strategy policy & exact result on incorruption. To compare & investigate the laws and systems for incorruption of some developed countries or areas (like USA, Japan, Hong Kong, Singapore, South Korea, … etc.). Concluding the advantages and disadvantages for various systems to create an in-corruptive police as the reference for our country. This research has found: 1. It is worth for us to learn the experience of incorruption from some developed countries or areas. 2. Our in-corruptive organizations are separately established in their own policy. Put them under the same policy would strengthen their entire function. 3. A part of in-corruptive laws should be modified to meet the requirements of function for incorruption. 4. Most people remain indifference about the incorruption. It is essential to enhance the dissemination of legal education and establish a supervision system together with the entire people in order to maintain a clean and efficient government. Suggestions of this research: 1. To avoid the corruption by implement the law strictly. 2. Elaborate the function of audit to correct the corruptive & illegal behavior on finance. 3. Reinforce the training in a specialty of in-corruptive personnel. 4. Modify the government purchase law about the best bid for examinational system 5. Actually execute the system of declaration property for the officials. 6. Carry out the system of serving at a post or place on a fixed period by job rotation. 7. Build up the moral and legal concept. 8. Establish a specific in-corruptive organization. 9. The government leader must have the determination of incorruption.
