摘要

2010年6月22日出版的商業周刊1126期的專欄中，臺灣數位出版聯盟理事長同時也是城邦出版集團首席執行長何飛鵬發表「最後的五年」一文，認為紙本出版在五年後將失去商業經營價值，說明了數位出版的時代即將來臨。
有鑑於此，本研究旨在探討我國數位出版品之著作授權與交易模式，透過分析國內數位出版版權授權發展情形，擬定適合本國之版權交易與授權之模式，並探討國內著作權在公版書、孤兒著作與版權書之發展，與個別授權與應用。
在研究方法上，本研究採用個案分析與深度訪談法進行探索性研究。研究結果發現，版權的計算方式與DRM機制是影響業者是否投入數位出版之關鍵因素，另外，數位授權機制與線上平台建置完善亦是影響未來數位出版的發展走向。希望藉由此研究之分析，能釐清數位出版長久以來著作授權之問題，並提供相關業者或政府單位實質上之幫助。

Column of Business Week,-1126published on June 22, 2010,The chief CEO- Fei Peng Ho of Taiwan Digital Publishing Forum and also Cite Media Holding Group is announce an rticle「The last five years」,he think that the paper published will lost the value of commercial operation after five years，it means the digital published is coming.

In view of this, the aim of this research is to confer on copyright authorized and transaction of digital ublications. According to analysis copyright authorized of digital published for Taiwan, and we try to find out a suitable model of copyright authorized and transaction of digital publications, and also Investigate copyright development on books of public domain、orphan works and copyright books.

The result show the copyright formula and the DRM mechanism is the impact of industry on digital publication of the key factors, otherwise digital licensing mechanism and online platforms to establish a complete and affect the future of digital publishing development trend. According to the research, I hope to clarify the problems of authorized by publishing for a long time, and provide real help for the firms or government.
