摘要

專利說明書的撰寫品質和發明人的權益息息相關。專利為屬地主義，專利家族在全球佈局時語言轉換常有誤差。由於整體專利品質，除了語言，還須考量許多其他因素，因此，在過去，專利譯者的角色較為隱晦不顯，相關的翻譯問題也較少受到討論。
本論文主要分為兩大部分。第一部份系統化介紹目前國內較少受到探討的專利翻譯相關資訊、國內外法規、常見用語及注意事項等等。第二部份由理論及實務層面探討專利說明書的相關翻譯問題。藉由翻譯理論、科技譯者法律責任、及國內外相關組織及規範等文獻，歸納出幾項可行的專利翻譯原則及修辭技巧，並將其實際運用於台灣、美國已公告的中英專利說明書中，以專利家族—美國專利US6824444與台灣專利TW592644的專利說明書為實例，探討不當翻譯可能造成的影響，以及十分重要的「專業術語」相關翻譯問題。最後，作者更參考世界脈動，依據國際級組織的相關規範及文獻提出建議。
希望藉由本論文的相關探討，讓讀者對專利說明書的翻譯特性有更清楚的輪廓，也期望突顯譯者在專利產業中的法律責任及重要性，共同追求「高品質」專利翻譯的目標。

Patent translation has a significant role in patent industry. However, to date, there has been relatively little research conducted on patent translation. The aim of this study is therefore twofold:
1.To provide an introduction of patent translation, consisting essentially of international laws, common legal usage and notices to patent translators.
2.To outline and illustrate several practical approaches for patent translation based on three bodies of literature: translation theory, ethical rules for technical translators, and international organizations and rules relevant to patent translation. Translation terminology is also discussed and utilized in this study.

This thesis uses a practical example of the patent family—United States patent US6824444 and Taiwan patent TW592644 to discuss some translation problems. In addition, it reports on the global trends and proposes the approaches for patent translation by examining the existing laws and regulations. It is hoped that this study may be contributing somewhat to the subject of patent translation which has been neglected.
