摘要

本文是針對保險法在自動駕駛中所提出的問題與訂方向的提出。因為傳統動力交通工具主要是責任保險以及汽車強制責任保險為保障之依據，所以本文主要是針對此兩款險種，在自動駕駛與人類生活接軌時，會產生制度上的問題。
前半部主要在講述保險制度的基本原則，藉由保險制度的理解，可以了解當自動駕駛車輛的演進，需要考慮那些保險的基本架構。接著會進入責任保險以及強制汽車責任保險的介紹，並藉以了解目前法律規範制度上是如何操縱該類保險規範以達保障之目的，以及對何種責任產生時有保險制度有其發揮的空間。
最後是對於自動駕駛交通工具的介紹，對於自動駕駛有基礎認識後，來討論在自動駕駛下會有什麼樣的民事責任情況產生。在產生責任後，哪些人能透過保險制度加以分散風險，這是保險法基本架構的問題。而則任保險與強制汽車責任保險又會有是否需要調整。為本文研究之方向。以期待社會能因為自動駕駛更為完善，而人類的生活向前邁進的同時，也可以受到完善的保障。

This article is aimed at the problems raised by insurance in autonomous driving and the direction of car booking. Because automobile power is mainly covered by liability insurance and automobile compulsory liability insurance, this article is mainly aimed at the dangerous types of autonomous driving. When driving is in line with human life, there will be institutional problems.
The first half is mainly about the basic principles of the insurance system. With the understanding of the insurance system, we can understand the evolution of self-driving vehicles and those basic insurance structures that need to be considered. Then I will enter the introduction of liability insurance and compulsory automobile liability insurance, and learn how the current legal norms and systems manipulate this type of insurance norms to achieve the purpose of protection, and what kind of liability arises when there is room for the insurance system to play its role.
Finally, it is an introduction to autonomous driving vehicles. After having a basic understanding of autonomous driving, let's discuss what kind of civil liability situations will arise under autonomous driving. Who can diversify the risks through the insurance system after liability arises? This is a question of the basic structure of the insurance law. However, there will be any need to adjust whether insurance and compulsory auto liability insurance need to be adjusted. This is the research direction of this article. It is hoped that society will be more perfect due to autonomous driving, and while human life moves forward, it can also be fully guaranteed.
