區塊鏈技術應用於商標管理

摘要


台灣在全球智慧財產的產業鏈上所扮演的角色,屬於知識文化上的輸入國,同時也是智慧財產權商品的收受者與消費者,而推行智慧財產權的概念的主要目的是為了鼓勵研發和保護原創。在商場的戰場上,也有許多商標爭奪的例子,這些訴訟最後判決的勝負關鍵除了兩個商標間的相似度外就是在於註冊的「時間」。隨著網絡上發表的文件大量增加,大家開始關心剽竊檢測的技術,而以往的檢測技術都只有比對,卻沒辦法有效證明圖片出現的先後順序。   本研究利用DeepAI所開發出的Image Similarity API來進行商標圖檔的相似度比對預處理,並架設以太坊區塊鏈,透過撰寫智能合約來記錄廠商們的商標圖檔及詳細資訊,利用區塊鏈技術中時間戳記和不可竄改特性等等,使得廠商在註冊上傳商標上能夠更加安心,且能夠記錄整個品牌商標的演進歷史。

The main purpose of intellectual property law is to encourage the creation of a wide variety of intellectual goods. So far, Taiwan still buys intellectual goods from developed countries. The main reasons for trademark infringement. First is similarity between the two trademarks, second is registration time of trademarks. Because people upload a large number of files by the Internet, so began to care about plagiarism detection technology. But people are more care about similarity and ignore the importance of time. This study uses the Image Similarity API developed by DeepAI to compare the similarity of trademark profiles. Record trademarks’information with Ethereum and Smart Contracts. Take advantage of the features of blockchain so that manufacturers can upload trademarks with confidence.
