人類幹細胞研究對人類治療法律和倫理問題研究

近代人類的知識水平與科技發展，立足於偉大前人的心血之上，無論是哪個領域的科技發展的速度越來越快，成果也是與日俱進。幹細胞科技也不例外，科學家們經過了一段長時間的研究，從幹細胞中發現了許多能治療人類疾病的希望，包括治療人類的癌症、罕見疾病、遺傳疾病或是人類器官再生……等等。隨著人類發展幹細胞科技的腳步越來越快，但制定的法律卻沒有跟上幹細胞科技發展的腳步，對於未知的恐懼使人們開始擔憂起幹細胞科技的道德倫理問題，最常被提出的議題即是圍繞著胚胎幹細胞的相關道德議題，包括研究胚胎幹細胞的胚胎來源問題、胚胎道德地位、胚胎是否在人性尊嚴保護範圍內……等等。本篇論文將蒐集過往實際案例與當代的幹細胞技術的發展狀況與進度，並著重觀察及探討其中的道德倫理議題、相關法益及人權思辨，並探討未來對於此類相關議題的趨勢、可能性或隱憂等觀點後，對議題進行重點整理與總結後提出個人想法與建議。

The modern human knowledge level and the development of science and technology are based on the efforts of the great predecessors. Every field of science and technology is developing faster and faster, the results are also advancing with the times. Stem cell technology is no exception. Scientists have been studying for a long time and have found many hopes for treating human diseases with stem cells, including treating human cancer, rare diseases, genetic diseases or human organ regeneration... and so on. The pace of stem cell technology is getting quicker and quicker, but the laws have not kept pace with the development of stem cell technology. The fear of the unknown has caused people to worry about the moral and ethical issues of stem cell technology. The most frequently argued topic is related to the ethical issues of embryonic stem cells, including the study of the embryonic origin of embryonic stem cells, the embryo's moral status, and whether the embryo is within the scope of human dignity protection, etc. This paper will collect past actual cases and the development status and the progress of contemporary stem cell technology; it will also focus on the ethical issues, related legal interests and human rights speculations. After exploring viewpoints such as future trends, possibilities or hidden worries, I will summarize the topics and proposed my personal ideas and suggestions.
