十二年國教國中公民與社會教科書法治教育之內容分析

摘要


中文摘要 本研究旨在探討十二年國教國中各版本公民與社會教科書法治教育的內涵,並採取內容分析研究法為主要研究方法。 首先針對各版本教科書法治教育內容的整體編排進行分析,並觀察各版本教科書在法治教育內容整體編排上是否有明顯差異。其次,透過統整國內外文獻、九年一貫課程與十二年國教課程中法治教育的內涵,設計本研究運用的法治教育內容分析類目表,作為本研究分析教科書法治教育內容的基準。最後本研究得到研究結果如下: 一、在法治教育內容的整體規劃上,各版本間有明顯差異。 二、在法治教育內容的總數量上,各版本以「南一版」出現次數最多,「翰林   版」次之,「康軒版」則出現次數最少。 三、在法治教育內容分析的主類目上,各版本皆以「憲法基礎概念與人權」出   現的次數最多。 四、在法治教育內容分析的次類目上、「南一版」與「康軒版」以「基本權利與   人權保障」出現次數最多,「翰林版」則是以「行政法規與行政責任」出現   次數最多。 五、在法治教育內容的內容呈現上,各版本間僅在次類目「家庭暴力的防治」、   「刑罰種類與目的」,以及「身分權與家庭生活」並無太大差異外,其餘次   類目的呈現內容上均有差異存在。 最後,希望透過本研究的結果,能提供教師在進行法治教育的建議,以及提供未來從事相關研究之方向。

Abstract This study aims to discuss the connotation of law-related education referred to in the junior high school social studies and civics and social study education textbook of the 12-year basic education, which uses Content Analysis as the main type of research method. Firstly, the author analyzes the overall design for law-related education content in each textbook edition and observes whether there are apparent differences among the editions in the overall design thereof. Secondly, through the integration of domestic and foreign literature, the 9-year consistent curriculum and connotation of law-related education contained in the twelve-year national education curriculum, the Content Analysis Category Table of law-related education used herein is designed as a benchmark for the analysis of law-related education in the textbooks. Finally, the results of this study are as follows: 1. There are manifest differences among the editions in the overall planning of the law-related education. 2. In terms of the total quantity of law-related education, the “Nanyi Edition” has made the most appearances, followed by the “Hanlin Edition”, with the “Kangxuan Edition” accounting for the least. 3. In terms of the main categories of content analysis of law-related education, “Basic Constitutional Concepts and Human Rights” appeared most frequently in each of the different editions. 4. Pertaining to the subcategory of the content analysis of law-related education, “Protection of Basic Rights and Human Rights” appeared the most in “Nanyi Edition” and “Kangxuan Edition,” while “Administrative Regulations and Administrative Responsibilities” appeared most frequently in “Hanlin Edition.” 5. With respect to the content presentation of law-related education, there is not much difference only in the subcategories “Domestic Violence Prevention”, “Types and Purposes of Punishment”, and “Right of Status and Family Life” among the editions. The presentation of the remaining sub-categories shows differences in content. Finally, the author hopes that the results of this study are able to give teachers advice on law-related education and directions for future related research.
