按環境影響評估,係事前以科學、客觀調查與分析等方式為之。而民眾參與係環境影響評估程序不可或缺之一環,且於近年來人民參與之權利日益重要。 全文可分為六章。本文介紹美國環境影響評估及奧爾胡斯公約外,並檢視我國環境影響評估中之民眾參與環境影響評估制度的缺失,與司法救濟之關連性。主要係以我國學說論述,並輔以美國、德國及日本學說為之,且以我國實務判決、大法官解釋及外國公約,加強論述之基礎,及探討我國行政程序法及其他相關法規中之民眾參與制度,包括陳述意見、聽證等,比較其中之異同,並評析其於環境影響評估法之適用之可行性。本文認為有改回聽證之必要,使民眾參與制度及其精神能於環境影響評法中確切的落實。 另由現行環境影響評估實務中,探究其缺失,並由我國司法實務及法理依據之前提下,找出解決或因應之方法。於最末加以撰文建議之,期能符合我國國情及實際需要,以找到最佳對策。盼本文能增進對民眾參與環境影響評估之了解,並期盼我國民眾參與環境影響評估制度能更加完善。
The environmental impact assessment is analyzed by scientific and objective methods beforehand. Citizen participation is a necessity to environmental impact assessment procedure. In recent year ,people’s right of participation is more important.This thesis can be divided into six chapters .This thesis not only introduces the environmental impact assessment of America and Aarhus Convention , but also inspects the weakness of public participation in the environmental impact assessment system and judiciary application, figure out the connection among each other. The scholarship of our country is superior introduced , the scholarship of America, German and Japan also introduced. And use the judguments of our country, interpretation of our country and Foreign Convention , in order to improve the thesis describing. Explores Administrative Procedure Act of our country and other relevant laws and regulations of citizen participation system, which covers that can be heard, right to be hearing, etc. Then compare the similarities and differences among them, and analyse the feasibility of adoption in the Environmental Impact Assessment Act. This thesis thought that switch to the right to be hearing is necessary, in order to implement the spirit of citizen participation in the Environmental Impact Assessment Act. Not only to find the weakness of the environmental impact assessment , but also use the judguments of our country and law to find the answers or modes. Finally, offer the suggestion, hope to match our country and actually need,in order to find the best way. Hope this thesis can help us better understand of public participation and advance the system of environmental impact assessment of our country to a better level.
