論全球治理下之資訊隱私權保障，以Google侵害資訊隱私權之爭議為例

摘要

在全球化的資訊時代下，藉由電腦日益強化的運算能力及網路無遠弗屆地傳播，個人資料在網路傳播運用的機會漸增。雖為人類帶來快速便捷的生活模式，但無所不在的網路資料擷取技術，卻也使得個人資料極易暴露在公共空間，嚴重侵害個人隱私權益。而網路無國界的特性，進一步促成「全球資訊社會」之形成。隨著網路日益普及化，以個人資料保護為核心的資訊隱私權，漸成為各國政府日趨重視的公共議題。
網路搜尋引擎龍頭Google公司，近年來不斷擴充網路業務範疇，透過新興科技與網路搜尋功能之結合，不僅能輕易獲取民眾之個人資料，加上網路空間永久保存及廣泛傳播的特性，侵害資訊隱私權問題更甚以往。由於國際間個人資料外洩案例日漸嚴重，實非單一國家能有效治理解決，面對愈趨繁複地資訊隱私權爭議，有賴各國政府、國際組織與業者間隱私權政策之協調整合，尋求彼此共識以建立有效之規範模式。針對Google引起廣泛的隱私權侵害爭議，本文嘗試分析Google在全球治理模式下如何解決隱私權規範議題，並從「全球治理」（global governance）角度探討國際間對於資訊隱私權的解決機制。
隨著Google等網路業者侵害個人隱私案例層出不窮，為因應國際社會關注個人資料保護議題的趨勢，我國於2010年通過「個人資料保護法」修正案，以期建立我國保護資訊隱私權之規範機制，然對於瞬息萬變地資訊科技發展，法令規範蓋有不足之處，惟有輔以業者自律與隱私權團體間政策之相互溝通協調，才能構築完善的隱私權規範機制，關鍵之處即在與能否賦予個人針對個人資料具有完整的自決權利，才能有效落實資訊隱私權之保障。

In the global informational age, personal information transmitted through computer and network opportunities incrementally. Although behavior brings quickly convenient, the data mining make personal data exposed in the public space and violate personal privacy rights. Network without borders bring about the "global information society". With the increasing use of Internet, the personal data-core information privacy, gradually become an important public issue.
Google in recent years continuously enlarge the category of the internet business. Search function through newly technology and the internet, not only can easily collect personal data, but also get the internet space to permanently keep and extensively spread. As the international personal data leakage cases become more serious, it is difficult that a single country can governance effectively. Facing the controversial information privacy , it depends on governments, international organizations and industry coordination and integration between the privacy policy of seeking consensus with each other to create effective models.This article analyses Google how solve the disputed legal issues, and researches the solution of the information privacy from global governance.
