原住民保留地政策執行評估之研究-以新竹縣尖石鄉為例

摘要


執行評估乃用以探討政策或方案執行過程中之內部動態,藉以瞭解政策或方案各部分如何相互配合以達致政策目標,亦即連續監測一項政策於執行階段之缺失,檢視行政機關之作業流程、資源分配情形、執行者意向及其所運用使標的團體順服的政策工具。鑑於以往之評估大多以專家角度思維,然原住民保留地政策須關注原住民族之需求,故本研究由政策利害關係人之角度,藉政策執行評估理論探討原住民保留地政策之執行成果對原住民所造成之影響及成效為何?本研究希冀透過原住民保留地政策之政策執行評估,以了解該政策當前對於原住民環境之影響,並據此提出相關政策建議。 此外,本研究依研究發現及各章之研究為基礎提出政策建議,是以本研究爰提具下列建議以資參酌: 壹、執行組織結構方面 一、建立中央與地方政府間之政策協調參與機制 二、地方政府執行單位間之權責應明確劃分 貳、法令規章執行力方面 一、原住民保留地政策之施行,需有完整之配套措施 二、對於原住民保留地之審查,應建立具體明確之指標 參、政策資源方面 一、人力甄選宜以專業為考量 二、中央或縣政府應將部份之核可權限下放予鄉公所,以縮短公文流程 三、補助款應視地方差異性而彈性發放 肆、標的團體方面 執行機關應於相關政策確定後,廣向原住民實施宣導,俾便政策之落實推動

Implemental evaluation is used for inspecting internal developments of policy or scheme executing process. In this way we can realize how policies or schemes cooperate with each other for achieving the target, which means continually monitoring the defects of a policy during implemental process, and examining implemental procedure, resource distribution, executive intention, and the policy tool which used for making its target groups obedient among administrative organizations. Since that the past evaluations always designed from experts’ view, but the policy of the lands reserved for aboriginal people must base on aboriginal people’s demands. Therefore, this study will stand in the stakeholders of the policy’s view to probe into how the result of the implement of the policy of the lands reserved for aboriginal people influences aboriginal people through policy implemental evaluation thesis. We hope, through the implemental evaluation of the policy of the lands reserved for aboriginal people, we can see the influences of this policy and give related suggestion according to the result. Furthermore, this study brings up some policy suggestions based on its result and those studies in each chapter. Thus we give the following advices as referral: 1. About implemental organizational structure (1)Contribute a policy coordinating and participating device between central and local governments. (2)There should be a clear distinction between responsibility and accountability between executive units in local government. 2. About the executive ability of laws and rules (1)Implementing the policy of the lands reserved for aboriginal people needs complete supporting measures. (2)Set up clarified target for inspecting the lands reserved for aboriginal people. 3. About policy resources (1)It is better to put professional factor into consideration for human resources selecting. (2)Central or county government should release partial authorities to township office for avoiding red tape. (3)Supplemental benefit should distribute flexibly according to local variations. 4. About target group Implemental organization should propagate to aboriginal people after contributing related policy in order to make policy implemented successfully.
