電子商務與消費者保護法關係之研究

摘要


在這網路世界發展快速的情況下,因網際網路沒有明顯的國界區隔等特性,其交易模式自不同於以往之型態。然就目前實務上來說,企業經營者與消費者有關網路交易之契約關係,係適用消保法中有關郵購買賣之規定。惟郵購買賣立法之初,並非在處理網路交易,是否適合一體適用,乃值得予以討論。 本文乃以網路交易之整體為結構,先就電子商務為探討,進而就我國消保法之規定為介紹,最後在針對實務上所遇到之爭議類型提出探討並提出相關建議。第一章為序論,說明研究動機和研究方法;第二章則針對電子商務之定義及類型為介紹,並就電子商務之主體類型及客體為進一步說明。然為因應電子商務交易類型之特殊性,並不同於傳統面對面交易類型,故本文特別針對網路交易價金支付方式及紛爭解決機制為特別介紹;第三章則討論我國消保法之演進流程及其立法特色,並針對消保法之適用客體與適用主體提出說明。且就網路交易之特性來說,其似與郵購買賣相同,故為充分了解郵購買賣之規定,乃就郵購買賣之立法目的、要件及特殊規定為介紹說明,再針對電子商務是否適用郵購買賣部分為探討;第四章則以舉例方式,並參酌相關法院與實務之見解,來探討實務上有關網路交易所面對之問題。第五章則為結論與建議,希冀中央主管機關與立法者可就網路交易之特性,考量是否有立法或修法之必要,以達充分保護消費者之意旨,並創造一個消費者與企業經營者雙贏之局面。

With the rapid development of the network world, the Internet doesn’t have obvious boundaries or segmentations between countries, so its transaction pattern is certainly different from the old patterns. However, in terms of the current practice of the online trade, the contractual relationship between the business operators and the consumers is applicable to the regulations related to mail-order sales under the Consumer Protection Statutes. At the very beginning when passing the law for mail-order sales, it didn’t deal with the online trade. Therefore, it deserves discussion whether it is uniformly applicable. This paper takes the whole of the network transaction as the structure, first discussing the E-commerce, and then introducing the regulation of the National Consumer Protection Statutes, finally proposing exploration and related suggestions for the dispute types encountered in the practice. Chapter One is introduction which expounds the motivations and study methods of this study. Chapter Two introduces the definition and types of E-commerce, and further illustrates the types of E-commerce subjects and objects. However, in order to cope with the special characteristics of the E-commercial transaction types, which is different from the traditional face-to-face transaction type, this paper specially introduces the payment means and dispute solving mechanism of the online trade. Chapter Three firstly discusses the evolution process and the legislation features of the National Consumer Protection Statutes, and puts forward illustrations to the subjects and objects applicable to the Consumer Protection Statutues. Therefore, in order to fully understand the regulations of mail-order sales, it specially describes the purposes, conditions and special regulations of the mail-order sales, and discusses whether the E-commerce is applicable to the part of mail-order sales. Chapter Four discusses the questions about the online trade met in the practice by listing examples and referring to the related opinions of the court and practice. Chapter Five is the study conclusions and suggestions, expecting the central authorities and legislators can adopt law-making or legal amendment model for the special characteristics of the online trade and create a win-win situation for both the consumer and the enterprise operator.
