本論文共分五章,內容主要研究我國、大陸以及國際公約關於船舶油污染損害賠償法制度及其比較,第二章分析國際公約架構,藉以得知最新國際趨勢。 近年大陸經濟起飛,已然成為世界經貿中心,原油需求量亦逐年上昇,加以其海岸線綿長,故近年大陸沿海、內河均頻傳船舶油污染事件。大陸目前為1992CLC之會員國,第三章藉由大陸船舶油污損賠法制相關爭議問題之釐清,了解公約在大陸內國法實踐情形。 第四章介紹我國船舶油污損害賠償法制,並以第二章、第三章研究結果與我國法作比較,得出我國法不足之處;並以近年發生於墾丁之「阿瑪斯號輪」油污案為案例,分析我國求償經過與訴訟上主張。 第五章綜合前三章研究結論,提出修法建議,俾使我國船舶油污損害賠償法制臻於完備。
This thesis comprises six chapters,mainly study on Taiwan、Chian and International convention about ship oil pollution damage compensation institutions.Chapter Two analyze the frame of International convention,and get the latest trend. Recently,China economic situation flies,and oil need getting much;so shih oil pollution accident frequently occuron the coast.Besides,China is the member of the Protocol to the International Convention on Civil Liability for Oil Pollution Damage,1992, Chapter Three introces the ship oil pollution compensation institutions relative disputes,for realizing International convention on practicing circumstances.Chapter Four introduces the ship oil pollution compensation institutions of our country,and compare with the Chapter Two and Chapter Three,For understanding the shortcomings of the ship oil pollution compensation institutions of our country.Besides,this chapter take the「Amorgos」oil pollution accident for example,analyze the litigation process.At last, Chapter Five combind other chapters,to get the revision of our country’s law for more perfect.
