殘酷的遊戲?少年集體性侵害之成因

摘要


我國從1997年頒佈性侵害防治法(現稱性侵害犯罪防治法),1999年修訂妨害性自主罪章以來,有關各種性犯罪類型(如約會強暴、亂倫、戀童、網路援交等)研究非常豐富,但可能因為集體性侵害加害人數多、犯案動機複雜、且有共犯關係,取得資料不易,相關研究極少,導致社會仍不瞭解為何一群人可在彼此觀看之下,行使性暴力行為。又根據中華民國刑案統計,近十年集體性侵害案件呈上升趨勢,當中集體性侵害案件之犯罪本質又以少年結夥犯行比例最高,顯見探索少年集體性侵害議題之重要性。 職此,本文從少年矯治機構中選出判決確定之適當樣本,深度訪談了三個集體性侵案件之所有涉案人,來探索與瞭解少年集體性侵害之犯案動機、共犯成員的組成、選擇被害對象以及犯罪情境、手法與犯罪時之心理歷程為何等問題。 研究結果發現: 一、共犯成員的聚合是透過物以類聚的方式;這些集體性侵害 加害少年們 皆有家庭功能不彰、離家、中輟、從事 偏差或違法行為 以及 流連於非正式之遊戲場域中(例如街頭、網咖)等特質,且受訪少年在本次犯案前,都曾經與該案件中的共犯從事其他犯罪行為。 二、在本研究中,集體性侵害犯案動機包含玩樂、競爭、刺激感的追求,以及羞辱、貶抑被害女性的作用。 三、加害人多半認識被害人,且知道這些受害者都不是「乖女生」。因此越熟識被害人的加害者,也就越容易成為集體性侵害共犯成員裡,性侵被害者的先鋒。 四、集體性侵害具有令共犯更大膽、模仿、匿名、無責等特性,導致成員進行或默許更多的犯罪手段,卻無法停止犯行。 五、參與集體性侵之加害者具有中立化犯罪的歷程。而且在犯案時缺乏犯罪感(不覺得自己是在犯罪,或者不覺得犯罪有什麼嚴重的)。 基於研究發現,本文提出了少年集體性侵害與少年單獨性侵害以及少年共同從事其他集體犯罪的相同與相異處,此外,也進一步分析與討論了女性主義觀點、群眾心理學之去個人化作用以及中立化等理論解釋對於少年集體性侵案件之適用性。

Taiwan's Sexual Assault Prevention Act was enacted in 1997. Since the chapter of Offences Against Sexual Autonomy was amended in 1999, there have been many studies on various types of sex crimes (such as date rape, incest, pedophilia, network compensated dating, etc.) However, one area of particular interest ought to be group rape: it includes more than one victim, appears to have complex motivation, and a relationship of complicity. Yet, it is difficult to obtain data on group rape. Therefore, studies related to group rape are very rare and means our understanding is limited. Crime statistics data from the National Police Agency shows the number of group rape case has increased over the last decade. In terms of the criminal nature of these group rape cases, the proportion of juvenile people who commit crimes together is the highest. Obviously, the exploration of the issue of juvenile group rape is very important. As a result, this study examines this offence, sampling from those imprisoned in juvenile correctional facilities. By choosing three cases of group rape and conducting in-depth interviews, the study explores the criminal motivation behind juvenile group rape, the composition of the accomplices, the selection of victims, the situational dynamics, modus operandi, and the psychological process. Results: First, the process of gathering of accomplices is akin to “birds of a feather flock together”: in juvenile group rape, all of those offenders share some characteristics that indicate they have dysfunctional families, runaway experience, school dropouts, deviant and illegal behaviors, and the tendency to linger about in streets and internet cafes. In addition, as for these juvenile respondents who committed this group rape case, before they committed this group rape case, all of them had worked with other accomplices who also had involvement with group rape cases. Second, criminal motivation includes entertainment, competition, the pursuit of excitement, and the intention of humiliating and disparaging females. Third, most of the offenders knew the victim, and they perceive that the victim is not a “good girl”. Therefore, the more offenders are familiar with the victim, the more offenders are likely to become the pioneer and the accomplice in the group rape. Fourth, the form of the group rape is likely to make accomplices braver, more anonymous, and more irresponsible. Also, in this case, accomplices tend to imitate each other. Fifth, those offenders involved in group rape engage in neutralization processes. They lack the sense of having committed a criminal act (they did not think that they were committing crimes or the criminal behavior is serious). The discussion utilizes the feminist perspective, de-individuation mass psychology, and processes of neutralization to explain the nature of juvenile group rape cases.
