本文係有關於如何就組成功能性專利範疇中之物品專利請求項之構成要件,作分割、拆解,找出可行之原則性規範,稱請求項構成要件分解原則。請求項構成要件分解原則,主要係以歸納中華民國、中國和美國之專利法令,專利文獻中請求項之記載形式、構造特性和限制條件而獲得;並佐以圖理論為基礎,以易裝配性設計建構組裝模型,作組裝可行性評估和驗證;以模組化設計建構機構傳動模型,作傳動可行性評估和驗證。本文並以不同記載形式請求項之六案系爭專利為範例,將各系爭專利之請求項,依據本文發展之請求項構成要件分解原則重新作分解,獲得該六案系爭專利各自之構成要件,再將其中三案之構成要件分別與對應的系爭專利侵害判決案所明示之構成要件作對應比對,以驗證請求項構成要件分解原則之正確性和實用性。 本文所得之請求項構成要件分解原則,具有簡單易懂之特點,可快速且精準分解出請求項之構成要件,經由組裝可行性、傳動可行性和系爭專利侵害判決案之評估和驗證結果,顯示該分解原則具正確性和實用性,可提供專利相關從事人員,作為撰寫專利分析軟體、專利檢索、專利分析、量化專利權範圍、專利寫作佈局、專利審查、專利迴避設計、專利佈局、專利侵害鑑定、專利侵權訴訟攻防之運用。
This research is to study how to divide up, dismantle the assembly essential element of the functional patent claim, and find a possible principle standard, it is called the dividing principle of the essential elements for this claim. The dividing principle of the essential elements for this claim is generalized from the Republic of China (Taiwan), China and the United States patent laws, and obtained by the writing form, structural features and constraints of patent claim for patent literature, and based on graphs theorem, then used design for assembly to build assembly model to evaluate and verify assembly possibility, and used modular design to build mechanism transmission model to evaluate and verify transmission possibility. We also used six kinds of different writing form classic examples of the legal cases for the disputing patent, and the claim of the disputing patent in according the dividing principle of the essential elements for the claim based on this research to restart dividing, and obtained their respective essential elements. In order to confirm the correction and practical utility of the dividing principle of the essential elements for the claim, we compared the dividing essential elements of three disputing patent and the recorded essential elements of the opposite patent legal cases. The dividing principle is easy to understand and can divide the essential elements for the claim quickly and accurate, by the result of assembly possibility, transmission possibility and legal cases for the disputing patent to evaluate and verify. We know the dividing principle is exactly and practical, and can applications in patent areas such patent analyze software design, patent search, patent analysis, quantify the scope of patent, patent writing strategy, patent examination, patent design around, patent strategy, patent infringement judgment, patent litigation…etc.
