對於「全球治理」的概念,仍缺乏一個可被廣泛接受的界說,究其原因,或許在於全球治理與全球化概念一樣,存在著許多價值上的爭議。「聯合國全球治理委員會」(Commission on Global Governance)在1995年對「全球治理」所作的定義,顯示出治理的四項特徵:1.治理既不是一套規則,也不是一種活動,而是一個過程(process)。2.治理係奠基於協調,而不是以支配為基礎。3.治理同時涉及到公部門及私部門的行動者。4.治理並不是一個正式制度,而是有賴於持續的互動。 國際建制目前學者最常引用的定義是出自學者Stephen Krasner 的定義:「國際建制可以定義為一組隱性或顯性的原則(principle)、規範(norms)、規則(rules)和決策程序(decision-making procedures)。國際建制的設立可提供以下功能:1.增加國際互動協商、減低往來成本。2.改善消息質量、減少國際社會猜疑。3.協助成員希望形成、提供法律架構的依據。4.增加國際成員的互信、協助監督執行的工具。 本文將以全球治理的概念探討國際建制對國家主權的影響,按三聚氰胺事件中中國的實例,依序由「主權的演進」、全球治理概念的現況與未來發展以及主要的國際建制理論,依據案例資料以及相關文獻分別加以討論,藉以說明目前國際建制的發展、功能與對國家主權的影響和干預能力。
What does “Global Governance” means? The Commission on Global Governance made a standard definition of global governance stating that “Governance is the sum of many ways individuals and institutions, public and private, manage their common affairs. It is a continuing process through which conflicting or diverse interests may be accommodated and co-operative action taken. It includes formal institutions and regimes empowered to enforce compliance, as well as informal arrangements that people and institutions either have agreed to or perceive to be in their interest.” To mention to “International Regimes”, Stephen D. Krasner defined International Regimes as “Implicit or explicit principles, norms, rules and decision-making procedures around which actors’ expectations converge in a given area of international relations.” This thesis discusses the influence of international regimes to sovereignty from the concept of global governance. Taking example of Chinese milk scandal, this thesis expounds the development of sovereignty, the concept of global governance, the future prospect, and international regime theory. From the case study and references, this thesis illustrates the development and the function of international regime and how international regime impacts sovereignty.
