摘要

本文第一章為緒論，針對研究動機、目的、範圍及研究方式為說明；第二章介紹針對就學及服役階段分析志願役契約權利義務關係，並定性志願役軍人與國家間法律關係為行政契約，並介紹類似契約之異同；第三章針對現行志願役契約履約爭議部分進行探究，區分為契約權利義務所生之行政行為及契約外會影響契約關係改變之行政行為，；第四章先介紹現行志願役軍人履約爭議內、外部權利救濟制度，再針對實務運作與理論不同處進行探究；第五章為結論，對於現行爭議部分予以整理歸結，提出現行實務作法不足之處，以供立法者對相關法規範修訂及國防部未來契約內容修正之建議。

Chapter 1 is the preface,introducing the motive,purpose,scope and research methods of this study.
Chapter 2 analyzes the contractual rights and obligations in the phase of studying at school and serving in voluntary soldiers service contracts.The author further defines the legal relationship between voluntary soldiers and a nation as an administrative contract,and introducing the similarities and dissimilarities in similar contracts.
Chapter 3 focuses on contractual dispute over voluntary soldiers service contracts.The author classifies administrative behaviors into two types:one that results from contractual rights and obligations,and the other on that results from contract outside.
Chapter 4 first introduces the internal and external administrative remedies for contractual disputes,and then analyzes the differences between practices and theories.
Chapter 5 is the conclusion,summarizing the disputes and improvement advices for legislators to amend related laws and regulations.
